The petitioner seeks bail in a case registered under Sections 302, 201/34 of the Indian Penal Code. Allegation is that the son of the informant went missing. Later his dead body was recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.9.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. It is a case of last seen. There is no eye witness to the alleged occurrence nor there is any substantive evidence to suggest the implication of the petitioner in the present case.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Tedhagachh P.S. case No.79 of 2017.
