The petitioner seeks bail in connection with Didarganj P.S. Case No. 162 of 2024 instituted for the offence under Sections 341, 323, 325, 307, 379, 504, 506 & 34 of the Indian Penal Code.

The prosecution case briefly alleges that on 02.05.2024, while the informant and his brother were going to Patna, they were surrounded near Fatehpur Dam by the accused persons. One accused assaulted the informant on the head with a country-made pistol causing serious injury, while another hit his brother with an iron rod, fracturing the informant's hand when he tried to save himself. It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.09.2025. Petitioner bears seven (7) criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is delay of five days in lodging the FIR. As per allegation, petitioner assaulted the informant by means of iron rod, due to which his hand got fractured and the injury is opined to be grievous in nature. Nothing has been recovered from the conscious possession of the petitioner. Parties are agnates. Charge sheet has already been submitted in this case. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge-sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail, after framing of charge, if not already framed, on furnishing bail bonds of

Patna High Court CR. MISC. No.6903 of 2026(3) dt.24-02-2026 3/3 Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Didarganj P.S. Case No. 162 of 2024, subject to the following conditions:

(I) One of the bailors shall be own/close member of the family of the petitioner.

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
