This application, for grant of anticipatory bail, arises out of Kajra P.S. Case No. 28 of 2014, disclosing offences under Sections 364 and 120 (B) of the Indian Penal Code.
From the records, it transpires that the petitioner's application for anticipatory bail was rejected by learned Sessions Judge, Lakhisarai, on 08.12.2014.
Patna High Court Cr.Misc. No.36828 of 2016 (2) dt.08-09-2016 2/2 Nearly, one year and eight months thereafter, the present application, seeking anticipatory bail, has been filed. On this sole ground, I am not inclined to entertain this application for anticipatory bail.
This application is, accordingly, rejected.
It is, however, observed that if the petitioner, above named, appears before the learned court below, in connection with Kajra P.S. Case No. 28 of 2014, within a period of four weeks from today and seeks regular bail, his application shall be considered by the learned court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
