The petitioner seeks regular bail in connection with Mehadiganj PS case no. 67 of 2018 registered for the offence punishable under Section 365 of Indian Penal Code. The allegation is regarding the petitioner having abducted the victim girl.
The learned counsel for the petitioner, referring to the statement made by the victim girl under Section 164 of Code of Criminal Procedure before the learned Magistrate, has submitted that the victim girl has not alleged any abduction on the part of the petitioner and she had simply gone away with the petitioner, however it has been stated by the prosecutrix that no

It is further submitted that the petitioner has been falsely implicated in the present case by the parents of the victim girl. Lastly, it is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 29.08.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Patna City in connection with Mehadiganj PS case no. 67 of 2018. (Mohit Kumar Shah, J) rinkee/- U T
