2. The petitioner seeks bail in a case registered for the offence punishable under Sections 137(2), 87, 352, 3(5) of the B.N.S.
3. Petitioner is said to have kidnapped the wife of the informant and also assaulted her.

Learned counsel for the petitioner has submitted that the present case concerns kidnapping of the wife of the informant and the FIR itself discloses that he got to know during the course of search that his wife had been kidnapped by one Chandan Kumar for the purpose of committing rape along with other accused persons and that earlier also the said Chandan Kumar used to send obscene photographs of his wife on the mobile phone of the informant. It is further submitted that the

No.6356 of 2026(3) dt.26-02-2026 2/3 petitioner was not named in the FIR and subsequently his name transpired as the victim was said to have recovered from his house on the basis of some call data records. It is further submitted that the petitioner and the victim were in a love relationship and had even performed marriage with each other and were living as husband and wife and there was no forceful kidnapping. The petitioner had married the victim on the bonafide belief that she was unmarried and eventually it is the petitioner who has become the victim of circumstances. It is only after being recovered that the victim has narrated a different story in her statement recorded Section 183 of the B.N.S.S. for saving her own prestige. However, she has herself disclosed her age as 24 years. Further, the petitioner is in custody since 02.12.2025 with no criminal antecedent and charge-sheet has been submitted on 27.01.2026.
5. Learned APP for the State has opposed the application for bail.
6. Taking into consideration the facts and circumstances and also considering the fact that the victim is an adult woman and the FIR contains allegations against some other person and considering the possibility of a love relationship between the petitioner and the victim coupled with

No.6356 of 2026(3) dt.26-02-2026 3/3 the fact that the charge-sheet has also been submitted, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Pipra P.S. Case No. 384 of 2025.
