1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Bahadurpur Police Station Case No. 520 of 2023, disclosing offences under Sections 406, 420 of the Indian Penal Code.

3. As per the FIR, the informant entered into an agreement for purchase of a land belonging to three sisters namely Aditi Raj, Alka Nupur, and Priyanka Kumari. When the informant requested them to execute the sale deed, they refused thereby cheated the informant.

4. Mr. Uma Shankar Singh, learned counsel for the

Patna High Court CR. MISC. No.5624 of 2025(4) dt.23-07-2025 2/3 petitioner, submits that petitioner is husband of Priyanka Kumari. The matter has been compromised between the informant and the co-accused Aditi Raj, Alka Nupur and their husbands, but the petitioner has been left out in the compromise because there is a matrimonial dispute between the petitioner and his wife Priyanka Kumari. The sale deed has been executed in favor of the informant.

5. Learned Counsel for the OP No. 2 agrees that sale deed of the subject land has been executed in favor of the informant.

6. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that sale deed has been executed by the vendors in favor of the informant, I am inclined to grant the petitioner privilege of anticipatory bail.

7. This application is, accordingly, allowed.

8. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Darbhanga, in connection with Bahadurpur Police Station Case
