Heard learned counsel for the petitioner and learned APP for the State.
Learned counsel for the petitioner is expected to honour his undertaking to remove the defects as pointed out by the office when called upon to do so by the office. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Buxar (Muffasil) P.S. Case no. 134 of 2020 instituted for the offence under Sections 457 and 380 of the Indian Penal Code.
The prosecution case relates to theft of electronic items from the house of the informant and the same article has
Patna High Court CR. MISC. No.17527 of 2021(3) dt.01-02-2022 2/2 been recovered from the house of the petitioner. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has got no criminal antecedent. The house from where the alleged recovery has been made, is a joint family property. No overt act has been alleged against the petitioner and he is not named in the FIR.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and considering the fact that stolen items have been recovered from the house of the petitioner, this Court is not inclined to enlarge the petitioner on bail and, as such, his application for bail is rejected.
