Feeling aggrieved by his arrest, he filed Bail Petition No. 1330 of 2014 before the Adhoc Addl. Sessions Judge-V, Saran at Chapra. The learned trial judge has rejected the application. Except that he has repeated the contentions of the parties and rejected the prayer for bail, he did not apply his mind to the facts of the case at all. No specific overt act has been alleged against the petitioner except the allegation of general nature. The petitioner is in custody since 29.6.2014.

This application is allowed. Prayer for bail is granted. The petitioner, namely, Kaushal Kumar Chauhan @ Pintu shall be released on bail on furnishing bail bond of Rs.5000/- (Rs.

Patna High Court Cr.Misc. No.37746 of 2014 (3) dt.14-01-2015 2/2 Five thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Saran at Chapra, in connection with Tr. No.2420/2014 arising out of Complaint Case No.2009 of 2013.
