This application, for grant of anticipatory bail, arises out of Economic Offence P.S. Case No. 20/2012, disclosing offences under Sections 420, 465, 467, 468, 471 and 120(b) of the Indian Penal Code and Sections 18/12/13(1)(d) read with Section 13(2) of the Prevention of Corruption Act.

Learned counsel for the petitioner has submitted that the F.I.R. was registered in the year 2012. He submits that the entire case of the prosecution is based on documentary evidence and in course of investigation he presented himself before the investigating agency and cooperated in the process of the investigation. Now in view of submission of charge sheet by Economic Offences Unit,

Patna High Court Cr.Misc. No.43042 of 2017 (2) dt.20-09-2017 2/2 Patna on 22.05.2017, on the basis of which cognizance has been taken, there is no need for him to be taken into custody. He also submits that in this background, there is no chance for the petitioner to flee away from the course of trial, if he is granted anticipatory bail.

Considering the submission that the petitioner had appeared himself before the Economic Offences Unit for the purpose of investigation as and when required, this application is allowed. Let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Vigilance I, Patna in connection with Economic Offence P.S. Case No. 20/2012, subject to the condition laid down under Section 438(2) of the Cr.P.C.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
