====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-06-2023 Heard learned counsels for the petitioners and the State.

Petitioners apprehend arrest in a case registered for the offences punishable under Sections 302, 102/34 of the Indian Penal Code and Section 27 of the Arms Act. Petitioners are suspected to have killed the brother of the informant.

Learned counsel appearing for the petitioners submits that informant is not an eye witness of the occurrence and these petitioners have been made accused in this case only on suspicion because of old enmity. It is next submitted that earlier petitioners were made accused by the informant in Revilganj

Patna High Court CR. MISC. No.7451 of 2023(3) dt.20-06-2023 2/2 P. S. Case No. 114 of 2022 in which Police after investigation submitted final form and except suspicion no other material is available on record to prove the complicity of these petitioners in the aforesaid crime.

Considering the aforesaid facts and circumstances, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate- 10th, Patna in connection with Patliputra P. S. Case No. 587 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
