2. The petitioner seeks bail, who is in custody since 07.04.2022 in connection with S.Tr.No.391 of 2022 arising out of Barhara P.S. Case No. 220 of 2022, F.I.R. dated 19.03.2022 registered for the offence punishable under Sections 147,148,149,341,323,307,326,504,506 of IPC and Section 27of Arms Act.

3. Earlier the prayer for bail of the petitioner was rejected vide order dated 12.04.2023 passed in Cr. Misc. No.65443 of 2022.

4. Vide order dated 16.02.2024, a report was called for with regard to the present status of the trial. Report of the

Patna High Court CR. MISC. No.9706 of 2024(3) dt.03-04-2024 2/2 learned Trial Court dated 23.02.2024 reveals that total chargesheeted witnesses have been examined and the prosecution evidence also closed and case record reveals that the case is pending for recording statement of accused persons under Section 313 Cr.P.C.

5. Learned A.P.P. for the State, on other other hand, has vehemently opposed the prayer for bail of the petitioner and submits that the petitioner carries five more cases other than the present one.

6. Considering the aforesaid fact as well as report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with S.Tr.No.391 of 2022 arising out of Barhara P.S. Case No. 220 of 2022 pending in the court of learned 3rd Additional Sessions Judge, Bhojpur, Ara.

7. Prayer is refused.

8. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Nitesh/- U T
