The petitioners have preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the prosecution report, 495 litres of liquor was recovered from a Bolero vehicle of which the petitioners were the driver and cleaner.

It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from their vehicle or possession. They are in custody since 22.12.2020 and have no criminal antecedent.

Having heard learned counsel for the parties and in view of the petitioners not having any criminal antecedent, the petitioners are directed to be enlarged on bail in connection with Excise Case no. 115 of 2020 (arising out of P.R. no.5 of 2020) on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. District & Sessions Judge - cum - Special Judge, Excise, Bhagalpur.
