JUSTICE SUDHIR SINGH ORAL ORDER 12-08-2015 The petitioner is languishing in custody since 23.3.2015 in connection with Baisi P.S. Case No.44 of 2015 for the offences instituted under Sections 363, 370, 302, 201 and 120(B)/34 of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that there is allegation that on 20.3.2015 the son of the informant became traceless from the play ground and even after herculean efforts he could not be traced out, rather his dead body could be recovered from the maize field on 23.3.2015.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.3.2015 and the charge sheet has

Patna High Court Cr.Misc. No.24782 of 2015 (3) dt.12-08-2015 2/2 submitted in the present case. He has no criminal antecedent. It is a case of last seen. There is no eye witness to the occurrence. On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Purnea, in connection with Baisi P.S. Case No.44 of 2015 corresponding to 1198/15.
