Petitioner apprehends his arrest in a case registered under Sections 272, 273/34 of the Indian Penal Code and 30(a)41(1) of Bihar Prohibition and Excise Act, 2016. Informant has alleged that on receipt of secret informantion that illicit liquor has been kept in a house of Manager Ram (petitioner). He alongwith other police personnel raided the house when two miscreants tried to escape. However, one was apprehended, who disclosed his name as Vicky Kumar son of Manager Ram (petitioner).
It has been submitted on behalf of petitioner that the house belongs to his son Vicky Kumar who was apprehended on the spot and sent to judicial custody and from seizure list also it
Patna High Court CR. MISC. No.7921 of 2020(2) dt.29-02-2020 2/2 appears that the house belongs to Vicky Kumar. Petitioner resides separately and nothing was recovered from his possession nor he was apprehended on the spot, as such no offence under Excise Act is made against him. Petitioner was also implicated in one excise matter in which he was granted anticipatory bail.
Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Chapra Muffasil P.S. Case No. 413 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
