Petitioner is named in the first information report and the informant claimed that petitioner along with three named and three unknown persons entered into the house of the deceased and committed his murder. Furthermore, informant claimed that when petitioner and his associates were returning after committing murder of deceased, he noticed that FIR named accused Chandraket Singh was carrying fire arm in his hand. The post mortem report of the deceased reveals that deceased sustained only one fire arm injury. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Sikrahana at Motihari, East Champaran in Madhuban P.S. Case no. 129/2013.
