The petitioner seeks bail in Samastipur Rail Case No. 94 of 2021, PT No. 330/21, registered for the offence punishable punishable under Section 25(1-b)a, 26 and 35 of the Indian Penal Code and section 37(c) of the Bihar Prohibition and Excise Act, 2018.

Petitioner was apprehended with two live cartridges in inebriated condition.

It is submitted that no recovery has been made from conscious possession of this petitioner. It is stated in para 3 that petitioner has got criminal antecedent and he is accused in three cases, but in all the cases he is on bail. Petitioner is in custody

Patna High Court CR. MISC. No.10383 of 2022(2) dt.22-04-2022 2/2 since 02.09.2021. Investigation is complete.

Considering the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2nd-cum-Special Judge Excise, Samastipur in connection with Samastipur Rail Case No. 94 of 2021, PT No. 330/21.
