ABHISHEK REDDY ORAL ORDER 19-06-2024 By virtue of the interim order granted by this Court on 15.03.2024, the petitioner was directed to pay the outstanding amount of Rs.21,50,000/- (Twenty one Lacs fifth Thousand) by way of installments, this Court has directed the petitioner to deposit the above amount by way of installments and the last installment was to be paid by 15th May, 2024.

2. Learned counsel appearing on behalf of the petitioner has stated that due to some unavoidable circumstances, the petitioner could not pay the last installment within the date fixed by this Court. However the entire outstanding amount as directed by this Court has already been paid by 14th of June, 2024. Learned counsel appearing on behalf

Patna High Court CWJC No.2580 of 2024(3) dt.19-06-2024 2/3 of the petitioner has stated that the I.A. No. 02 of 2024 has been filed by the petitioner seeking extension of time granted by this Court for paying the last installment.

Learned counsel appearing on behalf of the respondents-Bank has stated that Bank has not rebutted the above statement made by the petitioner and has stated that the petitioner has paid the entire amount due but with some delay. That the petitioner has to pays the interest for the delayed payment on the last installment i.e. approximately 13,000/- to 14,000 and the Bank have no objection for closing the loan account and giving no due certificate.

4. Having regard to the above, I.A. No. 02 of 2024 is allowed. The petitioner is directed to verify with the Bank authorities and pay the interest amount on the delayed payment of the last installment i.e. approximately 13,000/- to 14,000/- or whatever amount is indicated by the Bank. In case the said amount is paid, the authorities are directed to close the loan account and release the documents mortgaged to the Bank and restore the physical possession of the subject property to the petitioner forthwith.

5. The petitioner shall pay the interest amount for the delayed payment of last installment as indicated by the Bank

Patna High Court CWJC No.2580 of 2024(3) dt.19-06-2024 3/3 within a period of two weeks from the date of information by the Bank. Thereafter the Bank is directed to close the loan account, return the documents mortgaged with it and put the petitioner back in physical possession within a period of two weeks thereon.

6. With the above directions, the present writ petition stands disposed of.
