Earlier, the bail petition of petitioner alongwith two co-accused was rejected, vide order dated 29.05.2020 passed in Cr.Misc. No. 2710 of 2020 (Annexure - 1).
The petitioner has renewed his prayer for bail on the ground of parity. It is submitted that co-accused Madho Manjhi, whose prayer for bail was also rejected earlier with this petitioner vide Annexure -1, has been granted bail by this Court, vide order dated 04.08.2021 passed in Cr.Misc. No. 26947 of 2021. It is further submitted that the case has already been committed to the court of Sessions, vide Sessions Trial No. 57 of 2020, and petitioner is in custody since 12.10.2019. Learned A.P.P. for the State has opposed the bail petition.
Patna High Court CR. MISC. No.6736 of 2022(2) dt.23-03-2022 2/2 Considering the period of custody and the fact that similarly situated co-accused has already been granted bail, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jamui / concerned court in connection with S.T. No. 57 of 2020, arising out of Laxmipur P.S. Case No. 378 of 2019.
