Heard both sides.

The petitioner seeks bail in a case under Section 395 of the Indian Penal Code.

A truck was looted. The informant, driver of the vehicle, alleged that the truck was looted by unknown criminals along with belongings of the informant and of assistant driver. The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. The petitioner was arrested on mere suspicion and his so-called confessional statement was

Patna High Court Cr.Misc. No.42327 of 2015 (2) dt.16-09-2015 2/2 recorded. Save and except confessional statement of the petitioner the investigating officer did not collect any further evidence. The petitioner is in jail since 25.02.2015 but he has not been put on T. I. Parade.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sherghati, Gaya in Sherghati P.S.
