The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegations in the FIR, 30 litres of country liquor was recovered from the dairy farm of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his person or possession. The alleged place of recovery cannot be stated to be under exclusive lock and key of the petitioner who is in custody since 24.12.2020 and has no criminal antecedent. Having heard learned counsel for the parties and

No.17518 of 2021(2) dt.27-08-2021 2/2 taking into consideration the facts and circumstances of the case including the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Bhagwanpur P.S. Case no. 327 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II - cum - Excise Court, Vaishali at Hajipur. Spd/- (Partha Sarthy, J) U T
