JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-09-2015 Petitioner seeks permission for making correction in Para 10 of the petition.
Accordingly, petitioner is permitted to make necessary correction in Para 10 of the petition within course of the day. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, the amount in question was handed over to the petitioner by the complainant but according to the complainant itself, he handed over cash and draft to petitioner at the direction of Principal of the said college and it was Principal of the said college, who had assured for admission and not the petitioner. Petitioner issued a cheque which became bounced, so at best
Patna High Court Cr.Misc. No.43212 of 2015 (2) dt.18-09-2015 2/2 petitioner can be made responsible for the offence punishable under section 138 of the Negotiable Instrument Act. Petitioner is in jail custody since 20.03.2015.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Danapur, Patna, in connection with Complaint Case No. 485C of 2007, subject to the condition that one of the bailor shall be a close relative of the petitioner who shall file an affidavit before the court below disclosing as to how he is related with her and furthermore, another bailor must be holder of the landed property.
