2. Learned counsel appearing for the Mines Department, Ms. Kalpana informs this Court that in the present

Patna High Court CWJC No.3618 of 2025(4) dt.15-04-2025 2/3 writ application, the writ petitioner has challenged the proceeding of Revision Case No. 03 of 2024 which on the date of filing of the writ application was pending before respondentMines Commissioner against the order contained in Memo No. 4158 dated 29.12.2023 passed by the Mineral Development Officer, Gaya consequent to order dated 21.09.2023 passed by this Court in CWJC No. 11767 of 2023. She further informs this Court that during the pendency of the present writ application, the Revision Case No. 03 of 2024 which was pending before the respondent-Mines Commissioner has attained finality and a final order has been passed on 07.03.2025. The writ petitioner has not challenged the said order by filing an Interlocutory Application. Hence, the present writ application has become infructuous as per learned counsel appearing for the Mines Department.

3. The learned counsel appearing for the petitioner admits that the Revision Case No. 03 of 2024 which was pending before the Respondent-Mines Commissioner has attained finality and a final order dated 07.03.2025 has been passed.

4. In view of the above facts and circumstances, the present writ application has indeed become infructuous and, as

5. However, liberty is granted to the petitioner to challenge the final order dated 07.03.2025 passed in Revision Case No. 3 of 2024, if he so desires.
