JUSTICE SUDHIR SINGH ORAL ORDER 09-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. As per the prosecution story, it is alleged that the petitioner and a co-accused looted rupees five thousand, PAN card, mobile phone containing two SIMs and motorcycle of the informant. The petitioner is in custody since 27.05.2015. Chargesheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. He is not named in the FIR. He has not been put on T.I. Parade. Made accused due to mistake of fact. It is submitted that the name of the petitioner has come in course of investigation. It has further

Petitioner is accused in five other cases of similar nature. It has been submitted on behalf of the State that petitioner is not named in the First Information Report.

Considering the aforesaid facts and circumstances, the petitioner abovenamed shall be released on bail after completion of nine months in custody since 27.05.2015 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Hulasganj P.S. Case No. 46/2014.
