The present application has been filed for modification of the order dated 04-10-2018 passed in Cr. Misc. No. 61899 of 2018 by which the petitioners were granted anticipatory bail in connection with Saraiya P.S. Case No. 245 of 2018 pending in the court of learned Special Judge, Excise Act, Muzaffarpur and the petitioners were directed to surrender and furnish bail bond in the court below within a period of six weeks. It is submitted on behalf of the petitioners that due to communication gap, the petitioners could not surrender and furnish bail bond in the court below well within the time. It is

Patna High Court CR. MISC. No.12858 of 2019(2) dt.14-03-2019 2/2 further prayed on behalf of the counsel for the petitioners that further time may be extended so that the petitioners could surrender and furnish bail bond in the court below. Considering the submissions made on behalf of the learned counsel for the petitioners and the grounds mentioned in the modification application, the period of surrender of the petitioners in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions shall remain the same as mentioned in the order dated 04-10-2018 passed in Cr. Misc. No. 61899 of 2018.

The order dated 04-10-2018 passed in Cr. Misc. No. 61899 of 2018 is modified to the extent as indicated above. The modification application is, accordingly, disposed of.
