Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered in connection with Sarsi P.S Case No. 130 of 2020 for the offences punishable under Sections 304B/34 of the Indian Penal Code. As per prosecution case, informant namely Miku Goswami, gave his fardbeyan that his sister namely, Barsha Devi( deceased) was married with co-accused Uday Goswami in the year 2019. After marriage in-laws of deceased including these petitioners started torturing due to none fulfillment of Rs. 50,000/- and one motorcycle as dowry. Informant in her statement, stated that the accused persons, set her sister, on fire, sprinkling Kerosene Oil. During course of her treatment she died. Learned counsel for the petitioner submits that petitioner no. 1
Patna High Court CR. MISC. No.17465 of 2021(2) dt.13-12-2021 2/2 is mother-in-law and petitioner no. 2 is Dewar, who have no concerned with the activity of the deceased and her husband Uday Goswami. Petitioners are also not present at the place of occurrence and there is no specific allegation against these petitioners. Husband of the deceased was still in jail custody.
In the facts and circumstance of the case, let the petitioners , above named, in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st class, Purnea in connection with Sarsi P.S Case No. 130 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
