The petitioner seeks bail in Chautarwa P.S. Case no. 142/2015, registered for the offences punishable under Sections 413, 414, 34of the Indian Penal Code.

The petitioner and Guddu Kumar Singh were going on motorcycle but the police intercepted them and on chase apprehended the petitioner and Guddu Kumar Singh. The petitioner was driving the motorcycle and from his possession one mobile was recovered. The motorcycle recovered from the possession of the petitioner was of one Gyani @ Dhyani Thakur. It is submitted that Guddu Kumar Singh was granted bail by the learned court below, as the motorcycle was recovered from joint possession of the petitioner. The fact is that Investigating

Patna High Court Cr.Misc. No.39477 of 2015 (2) dt.07-09-2015 2/2 Officer has specifically stated that the motorcycle was recovered from the possession of the petitioner not from Guddu Kumar Singh, but the petitioner is in jail since 24.05.2015 and he has got no criminal antecedent.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Chautarwa P.S. Case No. 142/2015.
