The petitioner apprehends her arrest in connection with Mahua P.S. Case no. 374 of 2018, registered under Sections 420, 467, 468, 471, 472 and 120-B of the Indian Penal Code.
Learned counsel for the petitioner submits that coaccused Md. Mahtab Alam, son of the petitioner was extended privilege of pre-arrest bail vide Criminal Miscellaneous No. 12114 of 2019 on 17.06.2019 with undertaking that bank draft of Rs. Ten Lakhs payable to O.P. No.2 shall be paid at the time of furnishing of bail bond in the Court below with further undertaking that remaining amount of Rs. Forty Lakhs will be payable to the O.P. No.2 on every two month by an installment
Patna High Court CR. MISC. No.8256 of 2019(3) dt.30-09-2019 2/2 of Rs. Ten Lakhsand once the total amount of Rs. Fifty Lakhs is paid to the O.P. No.2, the Court below shall confirm the provisional bail of co-accused Mahtab Alam.
Since, the dispute as alleged in the F.I.R. has been settled in terms of agreement as detailed in order dated 17.06.2019 passed in Criminal Miscellaneous No. 12114 of 2019, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hajipur, Vaishali in connection with Mahua P.S. Case No. 374 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
