The petitioner is in custody since 21.3.2014 in connection with Arwal PS Case No. 65/2014 registered for the offence under sections 370, 370(1), 372 and 373 of the Penal Code, section 6 and 8 of the POCSO Act and sections 3, 4, 5, 7 and 8 of the ATP Act, 1956.

It is submitted on behalf of the petitioner that she was arrested on false premises by the raiding party under the leadership of the S.D.P.O. It is stated that she long with her daughter, grand daughters and also two other girls were made to suffer the excesses of police and a false and frivolous case of prostitution was made out. It is further submitted on behalf of the

No.24040 of 2014 (3) dt.24-12-2014 2/2 petitioner that the girls so allegedly recovered from the premises of the petitioner have since given their statements under section 164 of the Cr.P.C. that they were not being subjected to any form of prostitution. The case diary has also been received. Learned counsel for the State has also gone through some paragraphs of the case diary but in none of the said paragraphs there is any story of the girls being subjected to prostitution.

Considering the aforementioned submissions and also the fact that the petitioner has been in custody since 21.3.2014, let petitioner Lalti Devi be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Arwal PS Case No. 65/2014.
