The petitioner is in custody in connection with Kudhani (Turki O.P.) P.S. Case No. 609 of 2018 for the offences under Sections 399, 402, 120(B) of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 13.12.2018. He further submits that allegation against the petitioner is that he was among the people assembled for committing loot and on raid petitioner was apprehended and some arms has been seized but nothing was recovered from the conscious possession of the petitioner.

Considering the aforesaid, the Court is inclined to

Patna High Court Cr.Misc. No.6856 of 2019(2) dt.06-02-2019 2/2 grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Chief Judicial Magistrate, West, Muzaffarpur in connection with Kudhani (Turki O.P.) P.S. Case No. 609 of 2018.
