The petitioner seeks bail in a case registered for the offences punishable under different Sections of the Explosive Substances Act.

The petitioner was granted bail by the learned Chief Judicial Magistrate in the year 2002, but the petitioner did not appear and his bail bond was cancelled on 15.11.2002. The petitioner was declared absconder vide order dated 22.06.2007. The petitioner has already remained in jail for 21⁄2 months for misuse of privilege of bail.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.38530 of 2015 (2) dt.04-09-2015 2/2 Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ad hoc Additional Sessions Judge-I, Gaya in Sessions Trial No. 888 of 2007/276/2005, arising out of Magadh Medical P.S. Case No. 22 of 2001, subject to the condition that if the petitioner fails to appear on two consecutive dates, the learned court below shall cancel the bail bond of the petitioner.
