JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named and it appears from perusal of the impugned order as well as submission of the parties that near about after one month, the statements of the informant as well as one witness, Mithilesh were recorded u/S 164 of the Cr. P.C. in which, they named the petitioner.

Learned counsel, appearing for informant submits that not only the statements of aforesaid witnesses but it was location of mobile phone of the petitioner also, which establishes the involvement of the petitioner in the alleged occurrence. On the contrary, it has been submitted on behalf of the petitioner that prior to the alleged occurrence, some relatives of

No.43453 of 2015 (2) dt.21-09-2015 2/2 investigating officer of the present case, were convicted in Sessions Trial No. 48 of 1988 which had been lodged in respect of murder of father of the petitioner and that is the reason, the investigating officer of this case got implicated the petitioner in the alleged crime.

Considering the above-said submission as well as facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Asaon P.S. Case No. 03 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Siwan.
