The petitioner is a B.Ed. College, privately managed. It seeks direction to the respondents to grant recognition for running D.El.Ed. Courses from academic Session 2017-18. The petitioner-College has been granted recognition from academic Session 2018-19 by the National Council For Teachers' Education (NCTE). There is statutory cut-off date fixed for grant of affiliation, which has been noticed by the Supreme Court in case of Maa Vaishno Devi and ors. Vs. State of Utter Pradesh and ors. reported in 2013(2) SCC 617, which dated has crossed.

Patna High Court CWJC No.12713 of 2017(3) dt.13-10-2017 2/2 In a recent order, dated 15.09.2017, passed in Maa Vaishno Devi Mahila Vidyalaya and others on certain interlocutory applications, the Supreme Court, has refused to extend cut off date for grant of recognition any further. No relief as sought on behalf of the petitioner can, therefore, be granted by this Court.

It is, however, observed that if by any judicial order or otherwise the said date has been validly extended, the NCTE/Bihar School Examination Board may be approached by the petitioner, whereafter NCTE or the Board as the case may be shall be at liberty to take appropriate decision, in accordance with law.
