Petitioner seeks bail in a case registered for the offences punishable under Sections 341,323,307,337,302/34 of the Indian Penal Code.

The FIR discloses that at the spur of moment for flowing drain water, the petitioner assaulted with iron rod at the head of the husband of the informant, as a result whereof, husband of the informant died while on the way to the hospital. Petitioner is in custody since 19.03.2019. Petitioner has got no criminal antecedent. The trial has just started. Learned counsel for the informant opposed the prayer for bail.

Considering the facts of this case, there is no need for further detention of the petitioner as undertrial prisoner as the petitioner is ready to cooperate with the trial, hence let the

No.5595 of 2020(6) dt.01-03-2021 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Warsaliganj Police Station Case No.03of 2019 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
