JUSTICE SUDHIR SINGH ORAL ORDER 09-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)a, 26,35 of the Arms Act.

As per the prosecution story, the petitioner is alleged to have caught with one loaded country-made pistol and one 303 bore cartridge while he was trying to flee after seeing the Police. It has been submitted of behalf of the petitioner that the petitioner is in custody since 27.03.2015. Chargesheet has been submitted in the present case. There is no allegation of tempering with the evidence against the petitioner. As per the prosecution case, one loaded pistol and a live cartridge is said to have been

Patna High Court Cr.Misc. No.39122 of 2015 (3) dt.09-10-2015 P2/2 recovered from the conscious possession of the petitioner. The same is denied by the petitioner.

It has been submitted on behalf of the State that petitioner is named in the First Information Report.

Considering the aforesaid facts and circumstances, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Begusarai, in connection with Teghra P.S. Case No. 85/2015.
