The petitioners apprehend their arrest in connection with Pachrukhi P.S. Case No.107 of 2021, registered for the offenced punishable under Sectiond 147, 148, 149, 341, 447, 323, 325, 307, 379, 354, 385, 504 and 506 of the Indian Penal Code.

Learned Senior Counsel for the petitioners submits that he seeks permission to withdraw this anticipatory bail

Patna High Court CR. MISC. No.7257 of 2022(2) dt.01-08-2022 2/3 application in respect of petitioner no.2, Birendra Chaudhary as there is specific allegation against him.

Permission is granted.

Accordingly, this anticipatory bail application is dismissed as withdrawn so far as petitioner no.2, Birendra Chaudhary is concerned.

Learned Senior Counsel for the petitioner submits that the petitioners no.1, 3 and 4 are innocent and have falsely been implicated in the present case. It is further submitted that there is general and omnibus allegation against the petitioners. The injuries sustained by the injured persons are simple in nature. It is also submitted that the petitioners have got no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Taking into consideration the facts and circumstances of the case, let petitioners no.1, 3 and 4, namely, Arjun Chaudhary, Tulsi Kumar and Abhishek Kumar, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the
