JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking note of allegation, levelled against the petitioner, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Jamalpur P.S. Case No. 14 of 2014 corresponding to Sessions Case No. 385 of 2014 pending in the court of learned Additional District & Sessions Judge-I, Munger is, again rejected on the ground mentioned in my previous order dated 09-01-2015 passed in Cr. Misc. No. 26279 of 2014.
The trial court has reported that out of 5 proposed prosecution witnesses, uptill now, only two prosecution witnesses could be examined and to secure attendance of remaining
Patna High Court Cr.Misc. No.39022 of 2015 (3) dt.16-12-2015 2/2 prosecution witnesses, process has already been sent. The learned trial court is directed to conclude the trial of the petitioner within six months from the date of receipt/production of copy of this order, failing which, petitioner may renew his prayer for bail before the learned trial court itself. Let copy of this order be sent to the Superintendent of Police, Munger with direction to him to ensure the presence of remaining prosecution witnesses of Sessions Trial No. 385 of 2014 before the concerned court within three months from the date of receipt/production of copy of this order.
