JUSTICE SATYAVRAT VERMA ORAL ORDER 25-05-2023 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498(A) and 313 of the Indian Penal Code.

Learned counsel for the informant, at the outset, submits that he is not opposing the prayer for anticipatory bail of the petitioner for the reason that petitioner has agreed to pay an amount of Rs.6,000/- towards maintenance to the informant and the child to which learned counsel for the petitioner also agrees and submits that he has instruction to make submission on behalf of the petitioner that he is willing to pay monthly maintenance of Rs.6,000/- to the informant and the child commencing from 01.06.2023. Learned counsel for the informant, at this stage, submits

No.7963 of 2023(5) dt.25-05-2023 2/2 that he will seek the bank account number of the informant and will Whatsapp the same on the Whatsapp number of the learned counsel for the petitioner and the learned counsel for the petitioner undertakes to immediately send the bank account number of the informant to the petitioner. The maintenance amount so fixed will be subject to maintenance if any adjudicated and decided by a Court of competent jurisdiction.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with C.A. Case No. 486 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

In the event if the maintenance amount is not paid to the informant for two consecutive months, the informant would be at liberty to seek cancellation of bail of the petitioner. (Satyavrat Verma, J) Kundan/- U T
