JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with allegation that he shot fire on the deceased and informant claimed to have seen the alleged occurrence but submission on behalf of the petitioner is that the alleged occurrence is said to have taken place inside the hut and it was not possible for the informant to witness the alleged occurrence and as a matter of fact, the informant implicated the petitioner and other accused on account of previous enmity which is evident from perusal of Annexure-2 to this petition.

Regard being had to the aforesaid facts and circumstances as well as submission of the parties, I am not

Patna High Court Cr.Misc. No.45156 of 2015 (3) dt.04-02-2016 2/2 inclined to release the petitioner on bail and hence, his prayer for bail in connection with Akbar Nagar P.S.Case No. 45 of 2013, pending in the court of learned Judicial Magistrate, 1st class, Bhagalpur stands rejected.
