The petitioner is in custody in connection with Kateya P.S. Case No. 378 of 2018, registered for the offence punishable under Sections 30 (a), 35, 38 of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that in the instant case total 34 liters and 200 ML liquor was seized. He further submits that petitioner is in custody since 14.12.2018.
Considering the fact that the petitioner has no criminal antecedent, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees
Patna High Court Cr.Misc. No.6794 of 2019(2) dt.06-02-2019 2/2 ten thousand) with two sureties of the like amount each to the satisfaction of the Learned 2nd Addl. District Judge-cum- Special Judge, Excise Act, Gopalganj, in connection with Kateya P.S. Case No. 378 of 2018.
