2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 363/366A/34 of the Indian Penal Code.
3. As per the prosecution case, all the FIR named accused persons including these petitioners kidnapped informant's 17 years old daughter for the purpose of marriage.
4. It is submitted on behalf of the petitioners that specific allegation is against co-accused Shiva Kumar Sahni and petitioners have been roped in this case because of they being brother and father of said co-accused. During investigation the
Patna High Court CR. MISC. No.12756 of 2024(2) dt.12-03-2024 2/2 victim has stated that she was in love with said co-accused Shiva Kumar Sahni and she has not stated anything wrong against these petitioners. Petitioners claim clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Darbhanga in Moro Police Station Case No. 14/2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
