The petitioner seeks bail in connection with Kudhni P.S. Case No. 712 of 2019, registered under Sections 399 and 402/34 of the Indian Penal Code and Section 37(c) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that in course of patrolling, the informant received information that four criminals riding on two motorcycle were making planing for committing heinous offence, the informant proceeded towards tempo stand then four persons were seen near the hut. On seeing the Police party, all started fleeing, but two were apprehended, who disclosed their names Santosh Kumar Ram and Santosh Sahni (petitioner) and smell of liquor was coming from their mouth.

Learned counsel for the petitioner submits that petitioner is in custody since 30.10.2019. Further submission is that after apprehending in the present case, the petitioner has been remanded in Paroo P.S. Case No. 276 of 2019, registered under Sections 414 and 413/34 of the Indian Penal Code. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Spl. Judge Excise Act, Muzaffarpur in connection with Kudhni P.S. Case No. 712 of 2019. (Rajendra Kumar Mishra, J) manish/- U T
