JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-03-2022 Heard Mr. Yashraj Bardhan, learned Advocate for the petitioner and Mr. Ashok Kumar Singh for the State. The petitioner seeks bail in anticipation of his arrest in connection with Janta Bazar P.S. Case No. 189 of 2020 dated 25.10.2020 instituted for the offences under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code. The petitioner and another are said to have made attempts at drowning the informant in a ditch filled with water. As a result of this, the informant got injured. Learned counsel for the petitioner has submitted that there is a thirty hours delay in lodging the F.I.R. and the informant is non-else but the own uncle of the petitioner with whom he has litigation with respect to apportionment of his

The injuries suffered by the Informant are in the nature of contusion and abrasion which could have occurred in some other transaction also. None of the injury suffered by the Informant can be said to be life threatening. Regard being had to the aforesaid fact, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saran at Chhapra in connection with Janta Bazar P.S. Case No. 189 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
