According to the prosecution case itself, unknown person fired on the deceased and so far as the petitioner is concerned, it is only stated that he along with others was present on the place of occurrence when the occurrence took place.

Moreover, it is admitted by the informant in his written report that there was land dispute between him and the petitioner. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge I, Aurangabad in Sessions trial no. 262 of 2015/ 16 of 2015 arising out of Aurangabad Town P.S. Case no. 95/2015.
