The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

The prosecution case is that the daughter of the informant was enticed away by Chanchal Kumar, when the petitioners being Maternal-grand parents and maternal uncle also helped in enticing away the victim on 07.05.2015.

It is submitted by the learned counsel for the petitioners that the informatory petitioner was submitted by maternal uncle to the Officer Dharhara on 05.05.2015, where it was only alleged that Chanchal Kumar use to reside in the

Patna High Court Cr.Misc. No.37933 of 2015 (2) dt.18-09-2015 house of the petitioners' who enticed away the victim. It is further submitted that after one month of filing of the informatory petition being Dharhara P.S. Missing Case No. 4 of 2015, the present First Information Report was lodged where the accusation has been levelled against the petitioners. The petitioners are quite old persons and they have no criminal antecedent.

Considering the thrust of accusation against Chanchal Kumar and initially the petitioners being not named in the First Information Report, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Dharhara P.S. Case No. 100 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
