JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-04-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Learned counsel for the petitioner seeks permission to withdraw the bail application so far as petitioner no. 3 Triloki Thakur @ Triloki Chandra Thakur is cocnerned. Permission is accorded.

Petitioner nos. 1 and 2 apprehend their arrest in connection with Jhanjharpur P.S.Case No.36 of 2021 registered for the offences punishable under Sections 447, 441, 323, 307, 326, 34 of the Indian Penal Code.

As per the prosecution case, while the informant was standing on the road, all the FIR named accused persons including these petitioners assaulted him by means of iron rod,

Patna High Court CR. MISC. No.6918 of 2023(2) dt.17-04-2023 2/2 Khanti and Knife, as a result of which, he sustained several injuries.

Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. Specific allegation of assault by Khanti is against petitioner no. 3 Triloki Thakur, on account of which informant sustained eye injury. So far as injuries caused by petitioner no. 1 and 2 are concerned, they are simple in nature. Petitioners claim clean antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, Let petitioner no. 1 and 2 as above named, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Jhanjharpur, Madhubani in Jhanjharpur P.S. Case No. 36 of 2021, subject to condition as laid down under Section 438(2) of the Cr.P.C.
