JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is said to have given farsa blow twice causing head injury to the informant. The impugned order of learned Sessions Judge reveals that the informant sustained two injuries on her scalp but the nature of injury has not been mentioned in the impugned order.

Contention on behalf of the petitioner is that the informant sustained simple injury and moreover, the petitioner has been implicated in this case on account of previous enmity and he is in jail custody since 06-06-2015.

Considering the period of detention of the petitioner

Patna High Court Cr.Misc. No.42681 of 2015 (2) dt.17-09-2015 2/2 in jail custody as well as facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Motihari Muffasil P.S. Case No. 415 of 2013 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sadar, Motihari.
