2. Petitioner apprehends arrest in a case registered for the offence punishable under section 379 of the Indian Penal Code.
3. As per the prosecution case, some unknown miscreant stolen the handbag of informant from the train in handbag in which there was oneplus 7T mobile phone, gold chain, Credit card, cash of Rs. 4000/- and Aadhar card.
4. It is submitted on behalf of the petitioner that the name of the petitioner has falsely been implicated in this case on the statement of other co-accused person namely Devashish Ghosh . No looted article has been recovered from the possession of the petitioner and he is no way connected with the
Patna High Court CR. MISC. No.11419 of 2024(2) dt.22-02-2024 2/2 alleged occurrence . Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge - III, Begusarai in connection with Barauni P.S. case No. 153 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
