For the Petitioner/s : Mr. Niaj Kumar Yadav For the Opposite Party/s : Mr. Nagendra Prasad, APP ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 16-01-2015 Complaint Case No. 919 of 2010 was registered against the petitioner by Sasaram Police Station on a complaint submitted under Section 498A and other relevant provisions of the Indian Penal Code.
On earlier occasion, the petitioner was granted anticipatory bail by this Court through order dated 9.8.2011 in Cr. Misc. No. 19977 of 2011. However, on the ground of noncompliance of the direction issued therein, the bail bond was cancelled and he has been arrested on 1.7.2014. The petitioner filed BP No. 598 of 2014 in the court of Sessions Judge, Rohtas, Sasaram. The same was dismissed on 9.7.2014. Hence this application.
Patna High Court Cr.Misc. No.39333 of 2014 (2) dt.16-01-2015 2/2 Heard Mr. Niraj Kumar Yadav, learned counsel for the petitioner and Mr. Nagendra Prasad, learned APP. Except that there is some family problem for adjustment between the parties, there is no other serious dispute between them. The petitioner expresses his willingness to remain with his wife and children. The petitioner is in prison for nearly six months.
This application is allowed. The petitioner shall be released on bail on furnishing bail bond of Rs.10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Sasaram, Rohtas in connection with Complaint Case No. 919 of 2010. On release, the petitioner shall live with his wife and children and maintain them.
