The petitioner seeks bail in a case under Section 406, 409, 420/34 of the Indian Penal Code.

The petitioner along with two other accused persons, namely, Vikrant Singh and Gautam Kumar are named in the FIR for misappropriate Government money under the scheme MANREGA.

It is submitted that from annexure-2, it would appear that an enquiry was held and the work was found to be completed. Similarly situated accused Gautam Kumar has already been enlarged on anticipatory bail vide order dated 30.01.2015 passed in Cr. Misc. No. 3912 of 2015 and another accused Vikrant Singh has also been enlarged on bail. The case of petitioner stands on the

Patna High Court Cr.Misc. No.40435 of 2015 (2) dt.02-09-2015 2/2 same footing.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Desari (Chandpura) P.S. Case No. 299/2013.
