Petitioner apprehends his arrest in Bettiah Muffasil P.S. Case No.363 of 2018, registered under Sections 498A, 323, 341 and 34 of the Indian Penal Code.
The informant, wife of the petitioner, alleged that the petitioner and others in-laws came to her house to take her to her in-laws house but on refusal the accused persons assaulted her.
Learned counsel for the petitioner submits that the story disclosed by the informant is very unusual. The informant alleged that she was residing in her parents' house for last two years only because her husband used to assault her and he was intending to solemnize second marriage. It is submitted that the
Patna High Court Cr.Misc. No.8784 of 2019(2) dt.14-02-2019 2/2 entire allegation is false and concocted. The petitioner went to the house of the informant to bring her to his own house but the informant is reluctant to live with the petitioner. Taking into consideration the facts and nature of allegations made against the petitioner and the fact that the informant herself stated that her husband had come to take her to his own house, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Bettiah Muffasil P.S. Case No.363 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
